ENVÍOS Y DEVOLUCIONES
1. Comprar en nuestro sitio web
Al realizar un pedido en mallorcadistillery.com, el Cliente declara haber leído y aceptado las presentes Condiciones de Envíos y Devoluciones. Si no está conforme con alguna de ellas, debe comunicarlo a info@mallorcadistillery.com antes de realizar el pedido.
En estas condiciones, «Mallorca Distillery» es Mallorca Distillery, S.L.; «Cliente» es la persona que realiza un pedido; y «Consumidor» es el Cliente que actúa con un propósito ajeno a su actividad comercial, empresarial, oficio o profesión, conforme al Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios, aprobado por el Real Decreto Legislativo 1/2007 (en adelante, la «Ley de Consumidores»).
Los precios publicados incluyen el IVA y los demás impuestos aplicables. Los gastos de envío se muestran por separado antes de finalizar el pedido.
Mallorca Distillery debe recibir el pago íntegro del precio de los productos antes de aceptar el pedido. Una vez recibido el pago, confirmará la aceptación del pedido mediante un correo electrónico enviado a la dirección facilitada en el formulario de pedido. Con dicha confirmación queda celebrado el contrato de compraventa entre Mallorca Distillery y el Cliente.
2. Edad mínima
Para comprar en Mallorca Distillery es necesario tener al menos 18 años. Al realizar un pedido, el Cliente declara ser mayor de 18 años. Mallorca Distillery no vende bebidas alcohólicas a menores de edad y podrá cancelar cualquier pedido realizado por un menor, reembolsando el importe abonado.
La entrega solo se realizará a personas mayores de 18 años. El servicio de mensajería requerirá firma en el momento de la entrega y podrá solicitar un documento de identidad si no tiene certeza sobre la edad del destinatario. Si el destinatario no acredita su mayoría de edad, la entrega no se efectuará y el pedido será devuelto a Mallorca Distillery, que contactará con el Cliente para gestionar un nuevo envío (cuyos gastos podrán correr a cargo del Cliente) o la cancelación del pedido con el correspondiente reembolso.
3. Tramitación del pedido
Una vez realizado el pedido, este se tramitará en un plazo de 3 a 5 días hábiles. A continuación, el servicio de mensajería enviará al Cliente un correo electrónico con el número de seguimiento.
4. Entrega
Plazo. Mallorca Distillery se compromete a entregar los productos en el menor plazo posible y, en todo caso, en un máximo de 30 días naturales desde la confirmación del pedido, salvo que se acuerde expresamente otro plazo. Si Mallorca Distillery no entrega en plazo, el Consumidor podrá requerirle que cumpla en un plazo adicional adecuado a las circunstancias y, si tampoco se entrega en ese plazo adicional, podrá resolver el contrato y obtener el reembolso de todo lo abonado, conforme a la Ley de Consumidores.
Lugar de entrega. La entrega se realizará en la dirección indicada por el Cliente durante el proceso de pedido. No se entregarán productos en apartados de correos ni en cabinas.
Firma y transmisión de la responsabilidad. Se requerirá firma para toda entrega. Con la entrega al Cliente, o a un tercero designado por este distinto del transportista, la responsabilidad sobre los productos (incluido el riesgo de pérdida o deterioro) pasa al Cliente. Si el Cliente ha indicado como destinatario a una persona distinta de sí mismo (por ejemplo, en el caso de un regalo), acepta que la firma de dicha persona, o la firma en esa dirección de entrega, constituye prueba de la entrega y del cumplimiento por parte de Mallorca Distillery, y supone la transmisión de la responsabilidad en los mismos términos.
Comprobación del paquete. Si es posible, se recomienda comprobar el estado del paquete antes de firmar. Si presenta daños, no debe firmarse la entrega y el paquete debe devolverse al servicio de mensajería para que lo retorne a Mallorca Distillery. Si el daño se descubre después de firmar, el Cliente debe llamar al +34 871 704 310 o escribir a info@mallorcadistillery.com. Lo anterior se entiende sin perjuicio de los derechos del Consumidor en caso de productos dañados o defectuosos (véanse los apartados 8 y 9).
Imposibilidad de entrega. Si no es posible entregar el pedido por ausencia del destinatario u otra causa no imputable a Mallorca Distillery, el servicio de mensajería se pondrá en contacto con el destinatario conforme a sus procedimientos para acordar una nueva entrega.
5. Zona de envío y gastos de envío
Mallorca Distillery realiza envíos a la España peninsular y a las Islas Baleares. No se realizan envíos a las Islas Canarias, Ceuta ni Melilla. La dirección de entrega debe estar situada dentro de la zona de envío indicada.
Los gastos de envío corren a cargo del Cliente y se calculan y muestran antes de finalizar el pedido. El envío es gratuito para los pedidos de importe superior a 40 €.
6. Disponibilidad
Todos los artículos están sujetos a disponibilidad. Si alguno de los productos pedidos no estuviera disponible, Mallorca Distillery informará al Cliente lo antes posible y le reembolsará sin demora indebida el importe abonado por dicho producto.
7. Devoluciones y derecho de desistimiento
7.1. Derecho de desistimiento. El Consumidor que haya comprado en mallorcadistillery.com tiene derecho a desistir del contrato en un plazo de 14 días naturales, sin necesidad de justificación y sin penalización alguna.
7.2. Plazo. El plazo comienza el día en que el Consumidor, o un tercero designado por este distinto del transportista, adquiere la posesión material de los productos. Si el pedido se entrega en varias entregas, el plazo se cuenta desde la recepción del último producto.
7.3. Cómo ejercer el derecho. El Consumidor debe comunicar su decisión de desistir de forma inequívoca mediante una declaración en tal sentido, por cualquiera de estos medios: (a) correo electrónico a info@mallorcadistillery.com; (b) correo postal a Mallorca Distillery, S.L., Carrer del Gremi de Sucrers i Candelers 20, Nave 4, Polígono Son Castelló, 07009 Palma (Illes Balears); o (c) la función de desistimiento en línea disponible en este sitio web [PENDIENTE DE IMPLEMENTAR · véase Parte 3]. Puede utilizarse el modelo de formulario de desistimiento incluido al final de este documento, aunque su uso no es obligatorio. El plazo se considera respetado si la comunicación se envía antes de que finalice.
7.4. Devolución de los productos. El Consumidor debe devolver los productos a Mallorca Distillery sin demora indebida y, en todo caso, en un máximo de 14 días naturales desde que comunicó su decisión de desistir, a la dirección de Mallorca Distillery indicada en el apartado 11. Los productos deben devolverse en su embalaje original, sin abrir y con todos los precintos de seguridad intactos, y se recomienda embalarlos de forma segura para evitar roturas durante el transporte. Los costes directos de devolución corren a cargo del Consumidor, quien ha sido informado de ello antes de celebrar el contrato. A la recepción, Mallorca Distillery inspeccionará los productos antes de emitir el reembolso.
7.5. Disminución de valor. El Consumidor responde de la disminución de valor de los productos resultante de una manipulación distinta de la necesaria para establecer su naturaleza, sus características y su funcionamiento. Esto incluye, a título enunciativo, los casos en que la botella, el embalaje o el precinto estén dañados, rotos, abiertos o hayan sido retirados. En tal caso, Mallorca Distillery podrá deducir del reembolso un importe equivalente a dicha disminución de valor. Lo anterior se entiende sin perjuicio de los derechos legalmente reconocidos al Consumidor.
7.6. Reembolso. Mallorca Distillery reembolsará todos los pagos recibidos del Consumidor, incluidos los gastos de envío estándar, sin demora indebida y, como máximo, en 14 días naturales desde que haya sido informada de su decisión de desistir. El reembolso se efectuará por el mismo medio de pago empleado en la compra, sin coste alguno para el Consumidor. Mallorca Distillery podrá retener el reembolso hasta haber recibido los productos o hasta que el Consumidor acredite haberlos devuelto, según qué condición se cumpla primero.
7.7. Excepciones. El derecho de desistimiento no procede en los supuestos previstos en la Ley de Consumidores, entre ellos el de productos confeccionados conforme a las especificaciones del Consumidor o claramente personalizados.
8. Productos dañados o error en el envío
Si el Cliente recibe un producto dañado o distinto del pedido, debe escribir a info@mallorcadistillery.com o llamar al +34 871 704 310 (se recomienda adjuntar fotografías del producto y del embalaje). Mallorca Distillery se hará cargo de la recogida y de la sustitución del producto o del reembolso, sin coste para el Cliente.
9. Garantía legal de conformidad
Los productos están amparados por la garantía legal de conformidad prevista en la Ley de Consumidores. Mallorca Distillery responde de las faltas de conformidad que existan en el momento de la entrega y se manifiesten en un plazo de tres años desde la entrega. Salvo prueba en contrario, se presume que las faltas de conformidad que se manifiesten durante los dos primeros años ya existían en el momento de la entrega. El Consumidor tiene derecho a la reparación o sustitución del producto sin coste alguno y, cuando proceda conforme a la ley, a la reducción del precio o a la resolución del contrato. Estos derechos son irrenunciables. Para ejercerlos, el Consumidor puede contactar con Mallorca Distillery en info@mallorcadistillery.com o en el +34 871 704 310.
10. Reclamaciones, ley aplicable e idioma
Cualquier consulta o reclamación puede dirigirse a info@mallorcadistillery.com o al +34 871 704 310. El Consumidor conserva su derecho a acudir a los mecanismos de resolución extrajudicial de conflictos y a los juzgados y tribunales que resulten competentes conforme a la normativa aplicable.
Estas condiciones se rigen por la legislación española. Se facilitan en español y en inglés; en caso de discrepancia entre ambas versiones, prevalecerá la versión en español.

DELIVERY & RETURNS
1. Buying products on our website
By placing an order at mallorcadistillery.com, the Customer declares to have read and accepted these Delivery & Returns Terms. If the Customer is not satisfied with any aspect of them, they must contact info@mallorcadistillery.com before placing the order.
In these terms, “Mallorca Distillery” means Mallorca Distillery, S.L.; “Customer” means the person placing an order; and “Consumer” means a Customer acting for purposes outside their trade, business, craft or profession, as defined in the Consolidated Text of the General Law for the Defence of Consumers and Users, approved by Royal Legislative Decree 1/2007 (the “Consumer Law”).
Prices shown on the website include VAT and all other applicable taxes. Shipping costs are shown separately before the order is completed.
Mallorca Distillery must receive full payment of the price of the products before an order can be accepted. Once payment has been received, Mallorca Distillery will confirm acceptance of the order by email to the address provided in the order form. Such confirmation concludes the sales contract between Mallorca Distillery and the Customer.
2. Minimum age
To buy from Mallorca Distillery, the Customer must be at least 18 years old. By placing an order, the Customer declares to be over 18. Mallorca Distillery does not sell alcoholic beverages to minors and may cancel any order placed by a minor, refunding the amount paid.
Delivery will only be made to persons over 18. The courier will require a signature on delivery and may ask for proof of identity if unsure of the recipient’s age. If the recipient cannot prove they are over 18, delivery will not be made and the order will be returned to Mallorca Distillery, which will contact the Customer to arrange a new shipment (the cost of which may be borne by the Customer) or to cancel the order with the corresponding refund.
3. Order processing
Once an order has been placed, it will be processed within 3 to 5 working days. The courier will then send the Customer an email with the tracking number.
4. Delivery
Delivery time. Mallorca Distillery undertakes to deliver the products as soon as possible and, in any case, within a maximum of 30 calendar days from the order confirmation, unless another period is expressly agreed. If Mallorca Distillery fails to deliver on time, the Consumer may require it to deliver within an additional period appropriate to the circumstances and, if delivery is still not made within that additional period, may terminate the contract and obtain a refund of everything paid, in accordance with the Consumer Law.
Place of delivery. Delivery will be made to the address indicated by the Customer during the ordering process. Products will not be delivered to PO boxes or parcel lockers.
Signature and transfer of responsibility. A signature is required for every delivery. Upon delivery to the Customer, or to a third party designated by the Customer other than the carrier, responsibility for the products (including the risk of loss or damage) passes to the Customer. If the Customer has named a recipient other than themselves (for example, as a gift), the Customer accepts that a signature by that person, or at that delivery address, is evidence of delivery and fulfilment by Mallorca Distillery, and transfers responsibility in the same way.
Checking the parcel. If possible, the condition of the parcel should be checked before signing. If it is damaged, delivery should not be signed for and the parcel should be handed back to the courier to return to Mallorca Distillery. If damage is discovered only after signing, the Customer should call +34 871 704 310 or email info@mallorcadistillery.com. This is without prejudice to the Consumer’s rights regarding damaged or defective products (see sections 8 and 9).
Failed delivery. If delivery is not possible because the recipient is absent or for any other reason not attributable to Mallorca Distillery, the courier will contact the recipient in accordance with its procedures to arrange a new delivery.
5. Delivery area and shipping costs
Mallorca Distillery ships to mainland Spain and the Balearic Islands. It does not ship to the Canary Islands, Ceuta or Melilla. The delivery address must be located within the delivery area indicated.
Shipping costs are borne by the Customer and are calculated and shown before the order is completed. Shipping is free for orders over €40.
6. Availability
All items are subject to availability. If any of the products ordered is unavailable, Mallorca Distillery will inform the Customer as soon as possible and will refund the amount paid for that product without undue delay.
7. Returns and right of withdrawal
7.1. Right of withdrawal. A Consumer who has purchased on mallorcadistillery.com has the right to withdraw from the contract within 14 calendar days, without giving any reason and without penalty.
7.2. Withdrawal period. The period begins on the day on which the Consumer, or a third party designated by the Consumer other than the carrier, takes physical possession of the products. If the order is delivered in several shipments, the period runs from receipt of the last product.
7.3. How to exercise the right. The Consumer must notify their decision to withdraw by an unequivocal statement, by any of the following means: (a) email to info@mallorcadistillery.com; (b) post to Mallorca Distillery, S.L., Carrer del Gremi de Sucrers i Candelers 20, Nave 4, Polígono Son Castelló, 07009 Palma (Illes Balears), Spain; or (c) the online withdrawal function available on this website [TO BE IMPLEMENTED · see Part 3]. The model withdrawal form at the end of this document may be used, but its use is not mandatory. The deadline is met if the notification is sent before the period expires.
7.4. Returning the products. The Consumer must return the products to Mallorca Distillery without undue delay and, in any case, within 14 calendar days of notifying their decision to withdraw, to the Mallorca Distillery address given in section 11. The products must be returned in their original packaging, unopened and with all security seals intact, and should be packed securely to avoid breakage in transit. The direct costs of returning the products are borne by the Consumer, who has been informed of this before entering into the contract. On receipt, Mallorca Distillery will inspect the products before issuing the refund.
7.5. Diminished value. The Consumer is liable for any diminished value of the products resulting from handling other than what is necessary to establish their nature, characteristics and functioning. This includes, without limitation, cases where the bottle, packaging or seal is damaged, broken, opened or removed. In that case, Mallorca Distillery may deduct from the refund an amount equal to the diminished value. This is without prejudice to the rights legally granted to the Consumer.
7.6. Refund. Mallorca Distillery will refund all payments received from the Consumer, including standard shipping costs, without undue delay and no later than 14 calendar days from the day on which it is informed of the decision to withdraw. The refund will be made using the same payment method used for the purchase, at no cost to the Consumer. Mallorca Distillery may withhold the refund until it has received the products or until the Consumer provides proof of having returned them, whichever occurs first.
7.7. Exceptions. The right of withdrawal does not apply in the cases set out in the Consumer Law, including products made to the Consumer’s specifications or clearly personalised.
8. Damaged products or shipping errors
If the Customer receives a damaged product or one that differs from the order, they should write to info@mallorcadistillery.com or call +34 871 704 310 (photographs of the product and packaging are recommended). Mallorca Distillery will arrange collection and the replacement of the product or a refund, at no cost to the Customer.
9. Legal guarantee of conformity
The products are covered by the legal guarantee of conformity provided for in the Consumer Law. Mallorca Distillery is liable for any lack of conformity that exists at the time of delivery and becomes apparent within three years of delivery. Unless proven otherwise, any lack of conformity that becomes apparent within the first two years is presumed to have existed at the time of delivery. The Consumer is entitled to have the product repaired or replaced free of charge and, where applicable under the law, to a price reduction or termination of the contract. These rights cannot be waived. To exercise them, the Consumer may contact Mallorca Distillery at info@mallorcadistillery.com or on +34 871 704 310.
10. Complaints, governing law and language
Any enquiry or complaint may be sent to info@mallorcadistillery.com or made by phone on +34 871 704 310. The Consumer retains the right to use out-of-court dispute resolution mechanisms and to bring proceedings before the courts that are competent under applicable law.
These terms are governed by Spanish law. They are provided in Spanish and English; in the event of any discrepancy between the two versions, the Spanish version will prevail.
